Welcome to The Nose Lab. By accessing or using our website, booking a workshop, private session, custom fragrance development, or private label service with The Nose Lab, clients acknowledge and agree to comply with the following terms and conditions:
Ownership & Intellectual Property All content on this site, including text, images, logos, and designs, is the property of The Nose Lab and may not be reproduced without our written consent.
Fragrance & Formula Creations All fragrance formulas developed during workshops or custom development projects at The Nose Lab remain the intellectual property of The Nose Lab, unless otherwise agreed in writing.
Clients are purchasing an experience and/or finished perfume product, not the ownership of the fragrance formula. The Nose Lab may store and reproduce the fragrance formula for future production or refill purposes upon client request. If a client wishes to obtain ownership rights, exclusive use, or a formula buy-out, this must be subject to a separate written agreement and additional fees.
The Nose Lab reserves the right to use general fragrance concepts, accords, and olfactory ideas developed during sessions, provided that no client-specific brand identity or confidential information is disclosed.
Private Label & Custom Development The Nose Lab offers private label, custom fragrance development, and product development services. These services may include fragrance creation, technical coordination, regulatory documentation support, and liaison with third-party manufacturers and suppliers.
Unless otherwise agreed in writing, The Nose Lab acts as a development partner and coordinator, while the client or their company is responsible for the commercialization of the final product, including compliance with applicable regulations, designation of the Responsible Person, product notification, and market placement.
All fragrance formulas developed as part of private label or custom development projects remain the intelectual property of The Nose Lab, unless specific formula buy-out or transfer of rights agreement is executed in writing and subject to additional fees.
The Nose Lab may coordinate production with external manufacturers and suppliers; however, costs related to production, packaging, bottles, labeling, safety assessments, regulatory services, and logistics are not included in development fees unless explicity stated in writing and are typically borne by the client. Development fees cover creative, technical, and coordination services and are non-refundable once work has commenced.
Formula Buy-Out & Transfer of Rights If a client request ownership of a fragrance formula developed by The Nose Lab, this may be granted through a Formula Buy-Out agreement, subject to additional feed and a written agreement between both parties. A formula buy-out refers to the transfer of intellectual property rights of a specific fragrance formula to the client, allowing the client to use, reproduce, manufacture, or commission production of the fragrance independently of The Nose Lab. Until a Formula Buy-Out agreement is signed and fully paid, all fragrance formulas remain the exclusive intellectual property of The Nose Lab. Upon completion of the buy-out payment, The Nose Lab agrees to transfer the rights to use fragrance formula to the client. Unless otherwise agreed in writing, The Nose Lab reserves the right to retain the formula for archival purposes but will not reproduce, sell, or commercialize the same fragrance for other clients.
Formula buy-out fees are separate from development fees, workshop fees, or production costs, and reflect the transfer of intellectual property rights and creative work associated with the fragrance formula. All formula buy-out payments are non-refundable once the formula and documentation have been delivered to the client.
Use of Website This website is intended for personal use, including the purchase and booking of experiences. Any misuse of the site or its contents for third-party commercial gain or fraudulent activity is strictly prohibited. We reserve the right to modify content, prices and conditions without prior notice.
Booking & Payments All experiences must be booked in advance and can be scheduled up to 6 months ahead. Payment is due on the day of the experience unless otherwise arranged. To confirm your booking, we may request credit or debit card details. These will not be charged at the time of reservation. However, by providing your card information, you authorise The Nose Lab to charge the applicable fee in event of a no-show or a cancellation made less than 24 hours prior to the scheduled experience. Payment methods accepted are:
- Cash
- Credit/debit card
- Bank transfer or MB Way
The invoice will be sent by e-mail after payment has been confirmed.
Changes & Cancellations In order to guarantee an efficient service, we offer a flexible rescheduling and cancellation policy, which can be managed directly by the client through our booking website up to 24 hours before the appointment . We reserve the right to modify or cancel bookings under exceptional circumstances. Clients will be notified in advance when possible.
Refunds All experiences provided by The Nose Lab are non-refundable once they have been completed. By participating in any of our services, clients acknowledge that the experience has been delivered as agreed, and therefore no refunds will be issued under any circumstances after the service has been rendered. Gift Cards must be paid in advance within 24 hours after submission. Once a Gift Card is issued, the recipient must schedule the experience within 30 days of the issuance date. After this period, the Gift Card expires and cannot be used or refunded. No exceptions will be made for unused or expired Gift Cards.
Health & Safety At The Nose Lab, we are committed to providing safe and responsible experiences. All perfumery materials used in our sessions are handled in accordance with EU safety regulations. We carefully select ingredients with known safety profiles and ensure our workspace follows hygiene and ventilation standards. Participants are required to inform us in advance of any allergies, sensitivities, or health conditions that may affect their experience. Your wellbeing is our priority.
Limitation of Liability The Nose Lab is not liable for any indirect damages resulting from the use of this website or participation in our experiences.
Alternative Dispute Resolution The Nose Lab is a member of the Centro de Arbitragem de Conflitos de Consumo de Lisboa, authorized by Order 20/93 of May 4, of the Ministry of Justice, published in D.R. II Série, n. 118 of May 21, 1993. º 118 de 21/05/1993, with territorial jurisdiction for the Lisbon Metropolitan Area (Municipalities of Alcochete, Almada, Amadora, Barreiro, Cascais, Lisboa, Loures, Mafra, Moita, Montijo, Odivelas, Oeiras, Palmela, Seixal, Sesimbra, Setúbal, Sintra and Vila Franca de Xira), available at: https://www.centroarbitragemlisboa.pt.
